These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and The Business Growers LLC, doing business as The Business Growers ("The Business Growers", "we", "us", or "our"), concerning your access to and use of our website or landing page, as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. The Business Growers LLC ("we" or "us") operates a mobile messaging program (the "Program") subject to these Mobile Messaging Terms and Conditions (the "Mobile Messaging Terms"). By enrolling, signing up, or otherwise agreeing to participate in the Program, you accept and agree to these Mobile Messaging Terms and our Privacy Policy.

Definitions and Key Terms

You: A person or entity that is registered with The Business Growers LLC to use the services. (Note: you must be 18 years old or older.)

The Business Growers Mobile Messaging Program

Our campaigns send SMS Notifications, Alerts, and Occasional Marketing Communication to customers who have opted-in to receive SMS notifications.
You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

User Opt-In

By providing your mobile phone number to us, you are voluntarily opting into the Program and you agree to receive recurring mobile messages from us at the mobile phone number associated with your opt-in, even if such number is registered on any state or federal "Do Not Call" list. You agree that any mobile phone number you provide to us is a valid mobile phone number of which you are the owner or authorized user. If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number, you agree to promptly notify us at 888-688-7414. Your participation in the Program is not required to make any purchase from us, and your participation in the Program is completely voluntary.

User Opt-Out and Support

You may opt out of the Program at any time. If you wish to opt out and stop receiving mobile messages from us, reply STOP, QUIT, CANCEL, OPT-OUT, or UNSUBSCRIBE to any mobile message from us. You may continue to receive text messages for a short period while we process your request, and you may receive a one-time opt-out confirmation message. For support, reply HELP to any mobile message from us.

Cookies

The Business Growers LLC uses "Cookies" to identify the areas of our website that you have visited. A Cookie is a small piece of data stored on your computer or mobile device by your web browser. We use Cookies to enhance the performance and functionality of our website. Most web browsers can be set to disable the use of Cookies. Business Internet, VoIP, and Managed IT Services

Business Internet: Our business internet service involves the assessment, design, installation, and ongoing management of connectivity solutions, including dedicated fiber, broadband, fixed wireless, and 4G/5G backup. We strive to deliver reliable, high-performance connectivity; however, service availability, speeds, and uptime may depend on your location, third-party carrier infrastructure, and factors beyond our control.
VoIP and Phone Systems: Our cloud voice service includes the setup, number porting, and management of hosted VoIP and UCaaS phone systems. We ensure quality call service; however, VoIP call quality and availability depend on your internet connection, and we are not responsible for service interruptions caused by network outages or power failures outside our control. It is the customer's responsibility to maintain adequate connectivity and, where required, alternative access to emergency services.
Managed IT and Cybersecurity: Our managed IT service includes help desk support, network monitoring, patching, data backup, and cybersecurity measures. While we take all reasonable measures to protect and maintain your systems, we do not guarantee the prevention of every security incident, data loss, or downtime, as no system is entirely immune to threats or failures.

Kids' Privacy

We do not address anyone under the age of 18. We do not knowingly collect personally identifiable information from anyone under the age of 18. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 18 without verification of parental consent, We take steps to remove that information from Our servers.

Disclaimer of Warranty and Liability

The Program and services are offered on an "as-is" basis and may not be available in all areas or at all times. You agree that we will not be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent through the Program. Additionally, we are not responsible for damages resulting from service outages, network interruptions, third-party carrier failures, security incidents, or conditions beyond our control.

Modifications

We may modify or cancel the Program or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these Terms at any time. Any such modification will take effect when posted to our website. You agree to review these Terms periodically to ensure you are aware of any modifications. Your continued participation in the Program or use of our services will constitute your acceptance of those modifications.
